Initiated in Assembly 5 April 2000
A BILL
to amend the Equal Opportunity Act 1995 to prohibit discrimination
on the basis of breastfeeding and for other purposes.
Equal Opportunity (Breastfeeding) Act
2000
The Parliament of Victoria enacts as follows:
1. Purpose
The purpose of this Act is to amend the Equal
Opportunity Act 1995 to prohibit discrimination
on the basis of breastfeeding.
5 2. Commencement
This Act comes into operation on the day after the
day on which it receives the Royal Assent.

(1) In section 4 of the Equal Opportunity Act 1995,
as at 1 July
after the definition of "attribute" insert--
1998.
' "breastfeeding" includes the act of expressing
5 milk;'.
(2) After section 6(a) of the Equal Opportunity Act
1995 insert--
"(ab) breastfeeding;".
4. New section 223 inserted
10 After section 222A of the Equal Opportunity
Act 1995 insert--
"223. Transitional provisions--Equal
Opportunity (Breastfeeding) Act 2000
(1) Subject to this Act, a complaint may be
15 lodged after the commencement of the
Equal Opportunity (Breastfeeding) Act
2000 alleging a contravention of this Act
constituted by discrimination on the basis of
breastfeeding, whether the alleged
20 contravention took place before or after that
commencement.
(2) A complaint cannot be lodged as provided
by sub-section (1) if the alleged
contravention--
25 (a) took place before the commencement of
the Equal Opportunity
(Breastfeeding) Act 2000; and
(b) had been the subject matter of a
complaint lodged with the Commission
30 before that commencement.
(3) A complaint lodged with the Commission
before the commencement of the Equal
Opportunity (Breastfeeding) Act 2000 but

not finally disposed of immediately before
that commencement must continue to be
dealt with under this Act as if section 3 of
that Act had not come into operation.".
