PARLIAMENT OF VICTORIA A BILL to amend the Electricity Industry Act 1993 and the Electricity Industry (Miscellaneous Amendment) Act 1997 and certain other Acts and for other purposes. Electricity Industry (Amendment) Act 1998 The Parliament of Victoria enacts as follows: 1. Purpose The main purpose of this Act is to provide for the dissolution of Power Net Victoria and to facilitate the reduction of certain amounts and imposts. 1 532076B.I1-17/3/98

 


 

Electricity Industry (Amendment) Act 1998 s. 2 Act No. 2. Commencement (1) Sections 1, 3, 6, 9 and this section come into operation on the day on which this Act receives the Royal Assent. 5 (2) Section 10(2) is deemed to have come into operation on 24 December 1994. (3) Sections 4, 7, 8 and 10(1) (3) and (4) come into operation on 1 June 1998. (4) Subject to sub-section (5), section 5 comes into 10 operation on a day to be proclaimed. (5) If section 5 does not come into operation before 1 December 1998, it comes into operation on that day. 3. Principal Act No. 130/1993. 15 In this Act, the Electricity Industry Act 1993 is Reprint No. 3 called the Principal Act. as at 14 July 1997. Further amended by Nos 55/1997 (as amended by No. 91/1997) and 105/1997. 4. Repeal of provisions relating to mining Sections 12A and 12B of the Principal Act are repealed. 20 5. Power Net Victoria dissolved (1) In the Principal Act-- (a) in section 3, the definition of "Power Net Victoria" is repealed; (b) in section 3, in the definition of "electricity 25 corporation", omit "or National Electricity"; 2 532076B.I1-17/3/98

 


 

Electricity Industry (Amendment) Act 1998 s. 6 Act No. (c) in section 3, in the definition of "transmission company", paragraph (a) is repealed; (d) in section 3(2), paragraph (b) is repealed; 5 (e) in the heading preceding section 13, for "Power Net Victoria" substitute "Directions as to electricity supply system"; (f) sections 13, 14, 15 and 16 are repealed; 10 (g) in section 41E(1), paragraph (b) is repealed; (h) in section 91AA(2), paragraph (a) is repealed. (2) After section 100(3) of the Principal Act insert-- '(4) In this section, "chief executive officer" 15 means the Administrator.'. (3) On the commencement of sub-section (1)-- (a) Power Net Victoria is abolished; (b) all directors of Power Net Victoria go out of office; 20 (c) the chief executive officer of Power Net Victoria goes out of office. 6. Reduction in amounts and imposts After section 158C(3) of the Principal Act insert-- 25 "(4) An Order in force under section 158A may be amended, on the recommendation of the Treasurer, by one Order only of the Governor in Council published in the Government Gazette for the purpose of 30 facilitating a reduction in the amount payable by franchise customers to distribution companies for the purchase of electricity. 3 532076B.I1-17/3/98

 


 

Electricity Industry (Amendment) Act 1998 s. 7 Act No. (5) Despite sub-section (1)(c), an Order in force under section 163A may be amended, on the recommendation of the Treasurer, by one Order only of the Governor in Council 5 published in the Government Gazette for the purpose of facilitating a reduction in the imposts payable to the Treasurer.". 7. Easements (1) After section 73(1) of the Principal Act insert-- 10 "(1A) Despite sub-section (1), it is not necessary to produce a certificate of title in the case of a request for amendment to the Register in relation to transferred property that is an easement registered under the Transfer of 15 Land Act 1958.". (2) After section 108(1) of the Principal Act insert-- "(1A) Despite sub-section (1), it is not necessary to produce a certificate of title in the case of a request for amendment to the Register in 20 relation to transferred property that is an easement registered under the Transfer of Land Act 1958.". (3) After section 126(1) of the Principal Act insert-- "(1A) Despite sub-section (1), it is not necessary to 25 produce a certificate of title in the case of a request for amendment to the Register in relation to transferred property that is an easement registered under the Transfer of Land Act 1958.". 30 (4) After section 153L(1) of the Principal Act insert-- "(1A) Despite sub-section (1), it is not necessary to produce a certificate of title in the case of a request for amendment to the Register in 4 532076B.I1-17/3/98

 


 

Electricity Industry (Amendment) Act 1998 s. 8 10 Act No. relation to transferred property that is an easement registered under the Transfer of Land Act 1958.". (5) After section 153TJ(1) of the Principal Act 5 insert-- "(1A) Despite sub-section (1), it is not necessary to produce a certificate of title in the case of a request for amendment to the Register in relation to transferred property that is an 10 easement registered under the Transfer of Land Act 1958.". (6) After section 153TZA(1) of the Principal Act insert-- "(1A) Despite sub-section (1), it is not necessary to 15 produce a certificate of title in the case of a request for amendment to the Register in relation to transferred property that is an easement registered under the Transfer of Land Act 1958.". 20 8. Repeal of spent provisions In the Principal Act-- (a) sections 84E, 93, 95, 96, 97 and 158B are repealed; (b) Division 4 of Part 5, Division 4 of Part 9, 25 Division 4 of Part 10, Division 5 of Part 11 and Division 4 of Part 11A are repealed. 9. Commencement of section 11 postponed No. 35/1997 In section 2(2) of the Electricity Industry as amended (Miscellaneous Amendment) Act 1997, before by No. 55/1997. 30 "12" insert "11,". 10. Electricity Industry (Amendment) Act 1998 Act No. (1) In the Principal Act-- (a) in section 153TS(1), for "on which the the TCO" substitute "on which the TCO"; (b) in Schedule 2, for "trees more that 5 2·7 metres" substitute "trees more than 2·7 metres"; (c) in Schedule 3C, Part 2, Table A, in the item relating to SEC Lease Number C491, for "Marrets" substitute "Marretts". 10 (2) In section 14 of the Electricity Industry (Further Amendment) Act 1994, for "After section 71A" substitute "After section 71". (3) In section 17(3) of the Electricity Industry (Amendment) Act 1996-- 15 (a) after "distribution company" insert "means"; (b) for "Citipower Pty" substitute "Citipower Ltd". (4) In section 20(1)(c) of the Snowy Hydro Corporatisation Act 1997, for "section 20" 20 substitute "section 19". 6 532076B.I1-17/3/98
