Drugs, Poisons and Controlled
Substances Amendment (Repeal of
Part X) Bill 2007
A Bill for an Act to repeal Part X of the Drugs, Poisons and
Controlled Substances Act 1981, to amend that Act to close the Drug
Rehabilitation and Research Fund established under Part X of that
Act, to provide for the transfer of all money standing to the credit of
that Fund to the Consolidated Fund, to repeal a spent transitional
provision in the Confiscation Act 1997 relating to that Fund and to
make a statute law revision amendment to the Drugs, Poisons and
Controlled Substances (Amendment) Act 2006 and for other
purposes.
The Parliament of Victoria enacts:
1 Purposes
The purposes of this Act are--
(a) to repeal Part X of the Drugs, Poisons and
Controlled Substances Act 1981; and

(b) to amend that Act to close the Drug
Rehabilitation and Research Fund
established under Part X of that Act; and
(c) to provide for the transfer of all money
5 standing to the credit of that Fund to the
Consolidated Fund; and
(d) to repeal a spent transitional provision in the
Confiscation Act 1997 related to the Drug
Rehabilitation and Research Fund; and
10 (e) to make an amendment to the Drugs,
Poisons and Controlled Substances
(Amendment) Act 2006 in the nature of
statute law revision.
2 Commencement
15 (1) Sections 1 and 6 and this section come into
operation on the day after the day on which this
Act receives the Royal Assent.
(2) The remaining provisions of this Act come into
operation on 1 July 2007.

4 New section 141 inserted--Drugs, Poisons and
Controlled Substances Act 1981
At the end of Part XII of the Drugs, Poisons and
Controlled Substances Act 1981 insert--
5 "141 Drug Rehabilitation and Research Fund
(1) On 1 July 2007--
(a) the Drug Rehabilitation and Research
Fund is closed; and
(b) all money standing to the credit of the
10 Drug Rehabilitation and Research Fund
must be paid into the Consolidated
Fund.
(2) In this section, Drug Rehabilitation and
Research Fund means the trust fund
15 established by section 124 of the Drugs,
Poisons and Controlled Substances Act
1981 as in force immediately before 1 July
2007.".
