PARLIAMENT OF VICTORIA A BILL to amend the Bail Act 1977 and for other purposes. Bail (Amendment) Act 1998 The Parliament of Victoria enacts as follows: 1. Purpose The main purpose of this Act is to amend the Bail Act 1977 to clarify the conditions for granting of bail for certain drug offences. 5 2. Commencement This Act comes into operation on 1 January 1999. 1 532118B.I1-6/10/98

 


 

Bail (Amendment) Act 1998 s. 3 Act No. 3. Principal Act No. 9008. In this Act, the Bail Act 1977 is called the Reprint No. 6 Principal Act. as at 1 September 1997. 4. Amendment of definitions 5 In section 3 of the Principal Act, the definitions of "cocaine" and "heroin" are repealed. 5. Specified quantity of drug for Customs Act offences In section 4(2)(aa) of the Principal Act, for sub- paragraph (ii) substitute-- 10 "(ii) an offence under section 231(1), 233A or 233B(1) of the Customs Act 1901 of the Commonwealth in circumstances where the offence is committed in relation to narcotic goods within the meaning of that Act in 15 respect of a quantity that is not less than the commercial quantity (as defined in section 70(1) of the Drugs, Poisons and Controlled Substances Act 1981) applicable to the drug of dependence constituted by those narcotic 20 goods--". 6. Transitional provision After section 34(2) of the Principal Act insert-- "(3) The amendment of section 4(2)(aa) made by section 5 of the Bail (Amendment) Act 25 1998 applies only with respect to a charge for an offence filed on or after 1 January 1999.". 2 532118B.I1-6/10/98
