A BILL
to amend the Anzac Day Act 1958 to recognise and commemorate
service by Australians for their country in all conflicts, including
peace-keeping activities, to make other amendments to that Act, to
make various consequential amendments to other Acts and for other
purposes.
ANZAC Day (Amendment) Act 2003
The Parliament of Victoria enacts as follows:
PART 1--PRELIMINARY
1. Purposes
The main purposes of this Act are--
(a) to amend the Anzac Day Act 1958 to
5 recognise and commemorate service by
Australians for their country in all post-
World War I conflicts and in peace-keeping

activities as well as service in World War I;
and
Victorian Legislation and Parliamentary Documents
(b) to make amendments to that Act and various
other Acts to refer to "ANZAC" to recognise
5 the origins of that word; and
(c) to increase penalties for offences under laws
controlling activities on ANZAC Day.
2. Commencement
This Act comes into operation on the day after the
10 day on which it receives the Royal Assent.
3. Principal Act
See: In this Act, the Anzac Day Act 1958 is called the
Act No.
Principal Act.

4. Short title amended
In section 1 of the Principal Act, for "Anzac"
substitute "ANZAC".
5 5. Commemoration of ANZAC Day
(1) Insert the following heading to section 3 of the
Principal Act--
"Commemoration of ANZAC Day".
(2) In section 3 of the Principal Act--
10 (a) after "Empire" insert ", and in
commemoration of the service of Australians
for their country in subsequent conflicts and
peace-keeping activities,";
(b) for "Anzac" substitute "ANZAC".
15 6. Sports on ANZAC Day
(1) Insert the following heading to section 4 of the
Principal Act--
"Sports on ANZAC Day".
(2) In section 4 of the Principal Act, for "Anzac"
20 (wherever occurring) substitute "ANZAC".
7. ANZAC Day Proceeds Fund
(1) Insert the following heading to section 4A of the
Principal Act--
"ANZAC Day Proceeds Fund".
25 (2) In section 4A(1) of the Principal Act, for "Anzac"
substitute "ANZAC".
8. Use of cinemas
(1) In the heading to section 5 of the Principal Act,
for "Anzac" substitute "ANZAC".

(2) In section 5(1) of the Principal Act--
(a) for "Anzac" substitute "ANZAC";

for "5 penalty units" substitute "100 penalty
5 units".
(3) In the penalty at the foot of section 5(3) of the
Principal Act, for "5 penalty units" substitute
"100 penalty units".
9. Other entertainment
10 (1) In the heading to section 5A of the Principal Act,
for "Anzac" substitute "ANZAC".
(2) In section 5A(1) of the Principal Act--
(a) for "Anzac" substitute "ANZAC";
(b) in the penalty at the foot of the sub-section,
15 for "5 penalty units" substitute "100 penalty
units".
(3) In section 5A(3)(b) of the Principal Act, for
"Anzac" (wherever occurring) substitute
"ANZAC".
20 (4) In the penalty at the foot of section 5(5) of the
Principal Act, for "5 penalty units" substitute
"100 penalty units".
10. New section 7 inserted
After section 6 of the Principal Act insert--
25 "7. Transitional provision--ANZAC Day
Proceeds Fund
The ANZAC Day Proceeds Fund is deemed
to be the same Fund as it was before the
commencement of the ANZAC Day
30 (Amendment) Act 2003 despite the change
in its name by that Act.".

The Theatres (Repeal) Act 2002 is repealed.
13. Labour and Industry Act 1958
5 In clause 4 of the Seventh Schedule to the Labour
and Industry Act 1958, for "Anzac" substitute
"ANZAC".
14. Liquor Control Reform Act 1998
(1) In section 3(1) of the Liquor Control Reform
10 Act 1998, in the definition of "ordinary trading
hours", for "Anzac" (wherever occurring)
substitute "ANZAC".
(2) In section 108(3) of the Liquor Control Reform
Act 1998, for "Anzac" (wherever occurring)
15 substitute "ANZAC".
(3) In section 115(2) of the Liquor Control Reform

15. Lotteries Gaming and Betting Act 1966
20 (1) Insert the following heading to section 11A of the
