PARLIAMENT OF VICTORIA
A BILL
to appropriate certain sums out of the Consolidated Fund for the
Parliament for the financial year 1997/98 and for other purposes.
Appropriation (Parliament 1997/98) Act
1997
The Parliament of Victoria enacts as follows:
1. Purpose
The purpose of this Act is to appropriate certain
sums out of the Consolidated Fund for the
Parliament for the financial year 1997/98.
5 2. Commencement
This Act comes into operation on the day on
which it receives the Royal Assent.

3. Application of moneys
(1) The Treasurer may issue out of the Consolidated
Fund in respect of the financial year 1997/98 the
sum of one million three hundred and forty eight
5 thousand dollars as set out in Schedule 1 for
capital purposes and the sum of thirty five million
nine hundred and forty one thousand dollars for
current purposes as set out in Schedule 1.
(2) If--
10 (a) during the financial year 1997/98 the amount
payable in respect of salaries is increased as
the result of any act or determination; and
(b) the relevant amounts specified in Schedule 1
under the heading "Current Purposes" are
15 insufficient to provide for the payment of the
increased amount payable in respect of
salaries
the Treasurer may issue out of the Consolidated
Fund and apply such amounts not exceeding in
20 total the increased amount payable in respect of
salaries and any such amounts shall be and be
deemed to be appropriated in and towards the
service of the financial year 1997/98 in addition to
any other appropriation made by this Act.
25 (3) In sub-section (2)--
"salaries" includes wages or other payments in
the nature of salary, payments by way of
overtime or penalty rates or in lieu of long
service leave or for retiring gratuities;
30 "determination" includes any regulation or any
award order or determination of a person or
body authorised to determine minimum
salaries or wages under any law of the
Commonwealth or of the State, or any
35 Certified Agreement or Australian

Workplace Agreement approved in
accordance with the Workplace Relations
Act 1996 of the Commonwealth, or an
agreement entered into by or on the behalf of
5 the State.
4. Total amount to be issued and applied
The total amount that may be issued and applied
for or towards the service of the financial year
1997/98 pursuant to this Act shall not exceed the
10 sum of thirty seven million two hundred and
eighty nine thousand dollars and the amounts to
be applied for current purposes and capital
purposes, except as provided in section 6, in
Schedule 1 for that year pursuant to this Act shall
15 not exceed the amounts specified in that Schedule.
5. Appropriation
The sums issued and applied by this Act
amounting to thirty seven million two hundred
and eighty nine thousand dollars are appropriated
20 and shall be deemed to have been appropriated for
current purposes and capital purposes in and
towards the service of the financial year 1997/98.
6. Alteration to Parliamentary appropriation
The Presiding Officers with the consent of the
25 Treasurer may determine that part of an amount
appropriated by this Act for capital purposes or
for current purposes may be issued and applied for
the other of those purposes.
