INTERPRETATION ACT 1988 (BALLARAT DIOCESE)

INTERPRETATION ACT 1988

1. All Acts of the Synod shall be divided into sections if there be more enactments than one which sections shall be deemed to be substantive enactments without any introductory words.

2. This Act and every other Act to be passed by this or any future Synod after the passing of this Act may be altered, amended or repealed in any future Session provided that any Bill proposing any Act shall have been circulated to members of Synod at least four weeks before the first day of the Session of Synod at which the Bill is to be presented provided that Synod by an affirmative vote in each house of at least three fourths of the members present may declare any Bill to be a matter of urgency and permit it to be included in the Agenda of any Session of Synod without previous notice.

3. This Act and every other Act heretofore passed and every subsequent Act to be passed by this or any future Synod shall be numbered in regular annual arithmetical series each series to commence with the first and conclude with the last day of each year of our Lord.

4. Where any Act repealing in the whole or in part any former Act is itself repealed such last repeal shall not revive the Act or provisions before repealed unless words be added reviving such Act or provisions and whenever any Act shall be made repealing in whole or in part any former Act and substituting some provision or provisions instead of the provision or provisions repealed such provision or provisions so repealed shall remain in force until the substituted provision or provisions shall come into operation by force of the last made Act.

5. Wherever prior to the passing of this Act the words “United Church of England and Ireland” occur in any Act Resolution or Regulation of the Synod relating to the “Church of England” or the Church in the Diocese of Ballarat the same shall read as if they were “The Anglican Church of Australia”.

6. Where any Act is repealed every operation effected by or act done or as to any right or obligation already occurred or any liability already incurred under such Act shall remain effective save as the repealing Act shall otherwise provide.

7. Whenever any Act Regulation or Resolution heretofore passed by the Bishop the Clergy and the Laity of the Church in the Diocese of Ballarat the same shall read as if now in force and is binding upon the Bishop the Clergy or the Laity of the said Diocese reference is made to any Assembly or Assemblies Church Assembly or Church Assemblies such reference unless inconsistent with the context shall be deemed and taken to apply and to have always applied to the Synod or Synods of the Anglican Church of Australia within the said Diocese of Ballarat.

8. In all Acts Resolutions and Regulations heretofore or hereafter passed by the Synod unless a different meaning appear from the context

(a) the word “Bishop” shall mean the Bishop of Ballarat except where

stated otherwise.

(b) The word “Church” when applied to a building shall mean a building

of which the whole or some part is set apart consecrated or licensed for the worship of Almighty God according to the doctrines rites and usages of the Anglican Church of Australia.

(c) The words “Members of the Church” shall mean members of the

Anglican Church of Australia in the Diocese of Ballarat.

(d) The word “Clergyman” shall mean an Assistant Bishop, Priest or Deacon ordained according to the rites of the Anglican Church of Australia or according to rites of churches in communion with the Anglican Church of Australia in the Diocese of Ballarat or whose orders are recognised by the Church.

(e) The word “Priest” shall mean a Priest ordained according to the rites of the Anglican Church of Australia or according to the rites of churches in communion with the Anglican Church of Australia in the Diocese of Ballarat or whose orders are recognised by the Church.

(f) The words “Bishop in Council” shall mean the Bishop acting with

the advice and consent of the Council of the Diocese.

(g) The word “Parishioner” so far as the same relates to the exercise of any temporal or ecclesiastical right shall mean a Member of the Anglican Church of Australia resident in any Parish or Parochial District or having his ordinary place of business therein or who has during one year next before the exercise of any right claimed by him as a Parishioner been and continues to be a regular attendant of a church within the Parish, Parochial District or the Cathedral Church wherein such right may be exercised.

(h) The word “Rectory” means the dwelling-house in any Parish or Parochial District provided for the permanent use of the Clergyman in Charge thereof and the land connected and occupied therewith.

(i) The words “This Synod” shall mean the Synod of the licensed Clergy and the Laity of the Anglican Church of Australia in the Diocese of Ballarat as by law established.

(j) The word “Month” shall mean the calendar month unless words be added showing that a lunar month is intended.

(k) Words importing the masculine gender shall include the feminine and the singular shall include the plural and the plural the singular unless the contrary as to gender or number be expressed.
