Electoral treating
(1) A person must not directly or indirectly with the intention of influencing a person's election conduct at an election.(a) supply food, drink or entertainment; or(b) offer, promise or give a gift, donation or prize to or for any person, club, association or body (2) For the purposes of subsection (1) election conduct , in relation to a person, has the same meaning as in section 187 .(3) A person who contravenes or fails to comply with subsection (1) is guilty of the crime of electoral treating, punishable on indictment under the Criminal Code .(4) Notwithstanding section 389 of the Criminal Code , a person who is convicted of the crime of electoral treating is liable to a penalty of a fine not exceeding 100 penalty units or imprisonment for a term not exceeding 2 years, or both.(5) In proceedings for an offence under subsection (1)(b) it is a defence to show that gifts, donations or prizes similar in nature and in amount or value are regularly given to the club, association or body for similar purposes.
