S. M. GREEN Governor By His Excellency's Command, D. E. LLEWELLYN Minister for Health and Human Services _1. Short title_ These regulations may be cited as the _Food Regulations 2003_. _2. Commencement_ These regulations take effect on the day on which the _Food Act 2003_ commences. _3. Interpretation_ In these regulations, _"Act"_ means the _Food Act 2003_; _"Seafood Standard"_ means the Primary Production and Processing Standard for Seafood contained in chapter 4.2.1 of the Food Standards Code. _4. Incorporation of Food Standards Code_ The Food Standards Code, as in force from time to time, is incorporated in these regulations. _5. Meaning of appropriate enforcement agency in Food Standards Code_ The Director of Public Health or a council is the appropriate enforcement agency for the purposes of the Food Standards Code. _6. Infringement notice offences_ _(1)_ The offences that are created by the sections of the Act specified in Column 2 of the table in Schedule 1 are prescribed offences for the purposes of section 118 of the Act. _(2)_ For the purposes of the Act, the prescribed penalty for each of those prescribed offences is the penalty specified opposite that offence in Column 4 of the table in Schedule 1. _6A. Primary food production_ For the purposes of section 7(2) of the Act, the definition of "primary food production" in the Act does not include the following food production activities: _(a)_ primary production of seafood, as defined in clause 2 of the Seafood Standard; _(b)_ processing of seafood, as defined in clause 2 of the Seafood Standard. _7.
