WORKERS REHABILITATION AND COMPENSATION ACT 1988 - SECT 56

Division 5 - Miscellaneous 56. Provisions relating to evidence and production of documents

      (1) In a proceeding before the Tribunal –

(a) evidence may be taken on oath or affirmation;

(b) subject to any lawful claim or right of privilege, the Tribunal may, by notice in writing served on a person, require that person to appear before it to give evidence and to produce such documents, books, and things (if any) as are specified in the notice; and

(c) evidence may be given orally or in writing.

      (2) The Tribunal must cause a tape recording of a proceeding before the Tribunal to be made.

      (3) On the completion of a proceeding before the Tribunal, the Tribunal must cause the tape recording of the proceeding and any notes of the proceeding made by the Tribunal to be filed in the office of the Registrar in Hobart.

      (4) Any tape recording and notes of a proceeding filed in accordance with subsection (3) are to be kept for a period of 6 years from the date on which the tape recording and notes were filed.
