(1) The Minister, by order, may exempt specific well works or any
category of well works from the operation of this Division.
(2) The order is a statutory rule.
(3) For the purposes of subsection (1) , and without limiting the
Minister's discretion, a category of well works may be exempted by reference
to any or any combination of the following criteria:
(a) their purpose;
(b) their location;
(c) the amount of groundwater to be taken;
(d) their scale, design or method or time of construction;
