(1) Without limiting the power of a court to grant an adjournment in relation to any proceedings before it, the court may adjourn the hearing of the application for an order under section 40 if, before the court has made a final order to adjust interests with respect to the property of either or both partners, proceedings in relation to the property are commenced in the Family Court of Australia.
(2) If the hearing of an application for an order is adjourned under subsection (1), either partner may apply to the court for the hearing of the application to proceed.
