(1)  Division 1 applies to a disclosure referred to the Ombudsman under section 36 as if the disclosure had been made to the Ombudsman.

(2)  The Ombudsman must, within a reasonable time, notify the person who referred the disclosure under section 36 of the determination as to whether the disclosure is a public interest disclosure.
