PUBLIC HEALTH ACT 1997 - SECT 74F

Renewal of smoking product licence

(1)  The holder of a smoking product licence may apply to the Director to renew the licence.
(2)  An application is to be –
(a) in an approved form; and
(ab) accompanied by information or returns, if the licence was granted subject to a condition relating to the provision of that information or those returns by the licensee; and
(b) accompanied by the prescribed fee.
(3)  The Director may –
(a) grant the application subject to any conditions; or
(b) refuse to grant the application.
(4)  If an application to renew a smoking product licence is lodged and not determined before the licence expires, the period of the licence is extended until the application is determined.
(5)  The Director, by notice in writing served on the applicant, is to notify –
(a) the granting of the application; or
(b) the refusal to grant the application.

(7)  This Division, except section 74E , applies to the renewal of a smoking product licence as if it were the original application.
(8)  A licence renewed under this section is subject to any conditions the Director determines.
(9)  A licence renewed under this section takes effect from the expiry of the previous licence and remains in force, unless extended pursuant to subsection (4) , until whichever of the following occurs first:
(a) the date specified in the renewed licence;
(b) the expiry of 12 months from the expiry of the previous licence.
(10)  A smoking product licence is not, on renewal under this section, capable of being varied with respect to the premises specified on the licence.
