PUBLIC HEALTH ACT 1997 - SECT 111
Variation of licence
(1) A council, on its own volition or on application, may vary a licence to carry out any public health risk activity by omitting, adding, substituting or amending any condition of the licence.(2) Before varying a licence, the council is to consider (a) the manner in which the holder of the licence carried out the activity; and(b) the protection of public health.(3) The council, by notice in writing served on the holder of the licence, must notify variation of the licence.(4) The variation of a licence takes effect (a) if an application for a review is not made under section 163(d) , 28 days after service of the notice; or(b) if an application for a review is made under section 163(d) and the Magistrates Court (Administrative Appeals Division) makes a decision affirming the decision under review, on the day the decision was affirmed.
