If an elder of the Tasmanian Aboriginal community named in the notices referred to in sections 4(2) and 6(2) dies or otherwise becomes permanently incapable of acting as a trustee for the purposes of this Act, the Minister may, on the recommendation of such persons as he is satisfied represent the Tasmanian Aboriginal community, appoint another elder to be trustee of the remains in the place of that elder for the Tasmanian Aboriginal community.
