MONETARY PENALTIES ENFORCEMENT ACT 2005 - SECT 46
Default in paying in accordance with variation of payment notice
If a person given a variation of payment conditions notice or issued with an
MPCSO fails to pay in accordance with the notice or comply with the terms of
the MPCSO, the Director may –
(a) if an enforcement order has not been issued in respect of any monetary
penalty to which the notice or MPCSO applies, cancel the variation of payment
conditions or MPCSO without notice to the person and issue an enforcement
order; and
(b) if an enforcement order has been issued in respect of any monetary penalty
to which the notice or MPCSO applies, cancel the variation of payment
conditions or MPCSO without notice to the person and enforce the penalty in
accordance with Part 6 , 7 or 8 .
