LOCAL GOVERNMENT ACT 1993 - SECT 337

Council land information certificate

(1)  A person may apply in writing to the general manager for a certificate in respect of information relating to land specified and clearly identified in the application.
(2)  The general manager, on receipt of an application made in accordance with subsection (1) , is to issue a certificate in the prescribed form with answers to prescribed questions that are attached to the certificate.
(3)  A certificate under subsection (2) relates only to information that the council has on record as at the date of issue of the certificate.
(4)  A prescribed fee is payable in respect of the issue of a certificate.
(5)  The general manager, on request, may provide in or with the certificate any other information or document relating to the land that the general manager considers relevant.
(6)  A council does not incur any liability in respect of any information provided in good faith from sources external to the council.
(7)  A person, with the consent of the occupier or owner of specified land, may request in writing to the general manager that an inspection be carried out of that land to obtain supplementary information relevant to that land.
(8)  If the general manager agrees to a request under subsection (5) or (7) , the general manager may impose any reasonable charges and costs incurred.
(9)  In this section –
land includes –
(a) any buildings and other structures permanently fixed to land; and
(b) land covered with water; and
(c) water covering land; and
(d) any estate, interest, easement, privilege or right in or over land.
