LEGAL AID COMMISSION ACT 1990 - SECT 5

5. Membership of Commission

      (1) The Commission consists of 10 Commissioners appointed by the Minister of whom –

(a) one is a person appointed as the chairperson of the Commission; and

(b) one is the Director; and

(c) 2 are persons nominated by the Attorney-General of the Commonwealth to represent the Attorney-General or some other Minister of the Commonwealth who for the time being is administering the Attorney-General's portfolio; and

(d) 2 are persons representing the Minister, one of whom is a person with substantial experience and expertise in financial management; and

(e) 2 are persons nominated by the Law Society; and

(f) one is a person nominated by the Community Legal Centres of Tasmania after consultation with the Tasmanian Council of Social Services; and

(g) one is a person nominated by the staff of the Commission.

      (2) A person is not eligible for appointment as the chairperson of the Commission unless the person is –

(a) a former judge or a former magistrate; or

(b) a legal practitioner or a barrister of at least 5 years standing.

      (3) Schedule 1 has effect with respect to the membership of the Commission.

      (4) Schedule 2 has effect with respect to the meetings of the Commission.
