(1) As soon as practical after the commencement of this Act each council shall establish procedures to administer the provisions of this Act in respect of information contained in records in the possession of the council.
(2) Subject to subsection (3), nothing in this Act applies to information contained in records in the possession of a council until the Minister, by notice in the Gazette, declares that the Minister is satisfied that the council is able to administer this Act with respect to records in its possession and that this subsection accordingly ceases to have effect in respect of that council.
(3) If the Minister has not published a notice in accordance with subsection (2) on the anniversary of the commencement of this Act that subsection shall cease to have effect and this Act shall accordingly apply to all information contained in records in the possession of councils.
