If, at the conclusion of a review under this Part, the Ombudsman is satisfied that –
the Ombudsman shall bring the evidence to the notice of –(a) there is evidence that an officer of an agency has been guilty of a breach of duty or of misconduct in the administration of this Act; and
(b) the evidence is, in all the circumstances, of sufficient force to justify the Ombudsman doing so –
(c) if the officer is the principal officer of an agency – the responsible Minister; or
(d) in any other case – the principal officer of the agency.
