If, at the conclusion of a review under this Part, the Ombudsman is satisfied that
the Ombudsman shall bring the evidence to the notice of (a) there is evidence that an officer of an agency has been guilty of a breach of duty or of misconduct in the administration of this Act; and
(b) the evidence is, in all the circumstances, of sufficient force to justify the Ombudsman doing so
(c) if the officer is the principal officer of an agency the responsible Minister; or
(d) in any other case the principal officer of the agency.
