CLASSIFICATION (PUBLICATIONS, FILMS AND COMPUTER GAMES) ENFORCEMENT ACT 1995 - SECT 80

80. Matters averred to in complaint

      (1) In any proceedings for an offence against this Act, an averment in a complaint that a specified publication, film or computer game has been assigned a specified classification is, in the absence of proof to the contrary, to be accepted as proof –

(a) that the publication, film or computer game has been assigned that classification; and

(b) that the publication, film or computer game was so classified on the day the act alleged to constitute the offence in the complaint was committed.

      (2) In any proceedings for an offence against this Act, an averment in a complaint that a person was a child, a minor or a minor under 15 is, in the absence of proof to the contrary, to be accepted as proof that the person was a child, a minor or a minor under 15, as the case may be, on the day the act alleged to constitute the offence in the complaint was committed.
