COOPERATIVES ACT 1999 - SECT 85

85. Who may apply for court order?

The following persons may apply to the Supreme Court for an order under this Division:

(a) the Commissioner;

(b) a member who believes that the affairs of the cooperative are being conducted in a manner that is oppressive or unfairly prejudicial to, or unfairly discriminatory against, a member, or in a manner that is contrary to the interests of the members as a whole;

(c) a member who believes that an act or omission, or a proposed act or omission, by or on behalf of the cooperative, or a resolution, or a proposed resolution, of a class of members, was or would be oppressive or unfairly prejudicial to, or unfairly discriminatory against, a member or was or would be contrary to the interests of the members as a whole.
