If, as a result of an inspection, the Ombudsman is of the opinion that a member of the Tasmania Police Service has contravened the Commonwealth Act or that the Commissioner has contravened section 6(a), (b) or (c), the Ombudsman must –
(a) allow the Commissioner an opportunity to provide written comments in respect of that matter; and
(b) include in the report under section 9(b) or section 11(1) –
(i) a report on the contravention; and
(ii) a copy of the written comments of the Commissioner.
