VEHICLE AND TRAFFIC AMENDMENT (ROAD SAFETY LEVY) BILL 2007 (Brought in by the Minister for Infrastructure, the Honourable James Glennister Cox) A BILL FOR An Act to amend the Vehicle and Traffic Act 1999 Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Vehicle and Traffic Amendment (Road Safety Levy) Act 2007. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. 3. Principal Act In this Act, the Vehicle and Traffic Act 1999* is referred to as the Principal Act. *No. 70 of 1999 [Bill 24] 3

 


 

Vehicle and Traffic Amendment (Road Safety Levy) Act 2007 Act No. of s. 4 4. Section 40AA inserted After section 40 of the Principal Act, the following section is inserted in Part 6: 40AA. Road safety levy The regulations may ­ (a) provide for the imposition of a levy, in connection with the registration and renewal of registration of vehicles, for the purpose of improving road safety; and (b) fix the amount of the levy; and (c) provide for the payment of the levy; and (d) provide for concessions, waivers, rebates or exemptions related to the levy; and (e) deal with incidental and ancillary matters. 5. Sections 59A and 59B inserted After section 59 of the Principal Act, the following sections are inserted in Part 8: 4

 


 

Vehicle and Traffic Amendment (Road Safety Levy) Act 2007 Act No. of s. 5 59A. Road safety levies to be deposited into Special Deposits and Trust Fund If the regulations provide for the imposition of a levy for the purposes of section 40AA, the levies paid in accordance with those regulations are to be paid into an account in the Special Deposits and Trust Fund unless the Treasurer determines otherwise. 59B. Application of road safety levies (1) If the regulations provide for the imposition of a levy for the purposes of section 40AA, the levies paid in accordance with those regulations are to be applied only for the purposes of improving road safety, as determined by the Minister. (2) For the purposes of subsection (1), the Minister may consult with such persons and bodies as the Minister thinks fit. Government Printer, Tasmania 5
