STATUTORY OFFICERS (AGE FOR
RETIREMENT) BILL 2005

A BILL FOR
An Act to amend or abolish the age for retirement for
certain statutory officers
Be it enacted by His Excellency the Governor of Tasmania, by
and with the advice and consent of the Legislative Council and
House of Assembly, in Parliament assembled, as follows:
1. Short title
This Act may be cited as the Statutory Officers
(Age for Retirement) Act 2005.
2. Commencement
This Act commences on the day on which this
Act receives the Royal Assent.
3. Amendments to miscellaneous Acts
The legislation specified in Schedule 1 is
amended as specified in that Schedule.

SCHEDULE 1 AMENDMENTS TO MISCELLANEOUS
ACTS
Section 3
Alcohol and Drug Dependency Act 1968
1. Clause 1 of Schedule 1 is amended by omitting
subclause (3) and substituting the following
subclause:
(3) A person is not eligible to be appointed
as a member of the Tribunal if the person
has vacated the office of member of the
Tribunal under clause 4.
Consumer Affairs Act 1988
1. Schedule 1 is amended as follows:
(a) by omitting subclause (2) from clause 1;
(b) by omitting paragraph (b) from clause
3(1).
Coroners Act 1995
1. Section 12 is repealed.
Director of Public Prosecutions Act 1973
1. Section 5(2) is amended by omitting "65" and
substituting "72".

2. Section 9(2) is amended by omitting "65" and
substituting "72".
Forestry Act 1920
1. Schedule 2 is amended as follows:
(a) by omitting subclause (3) from clause 1;
(b) by omitting from clause 7(1)(h)
"absence; or" and substituting
"absence.";
(c) by omitting paragraph (i) from clause
7(1).
Gaming Control Act 1993
1. Schedule 2 is amended as follows:
(a) by omitting subclause (2) from clause 1;
(b) by omitting from clause 6(f) "absence;
or" and substituting "absence.";
(c) by omitting paragraph (g) from clause 6.
Government Business Enterprises Act 1995
1. Schedule 5 is amended as follows:
(a) by omitting subclause (2) from clause 2;
(b) by omitting paragraph (i) from clause
8(1).

Government Prices Oversight Act 1995
1. Clause 1 of Schedule 2 is amended by omitting
subclause (3).
Guardianship and Administration Act 1995
1. Clause 5 of Schedule 1 is amended as follows:
(a) by omitting subclause (3);
(b) by omitting paragraph (e) from subclause
(4).
Hospitals Act 1918
1. Clause 2(2) of Schedule 4 is amended by
omitting paragraph (h).
Industrial Relations Act 1984
1. Section 6 is amended as follows:
(a) by omitting subsection (1);
(b) by omitting paragraph (a) from
subsection (2).
Justices Act 1959
1. Section 7 is repealed.
Land Acquisition Act 1993

Magistrates Court Act 1987
1. Section 8(2) is amended by omitting "65" and
substituting "72".
2. Section 9(4)(a) is amended by omitting "65" and
substituting "72".
Mental Health Act 1996
1. Clause 5 of Schedule 1 is amended as follows:
(a) by omitting subclause (3);
(b) by omitting from subclause (4)(c)
"office; or" and substituting "office ";
(c) by omitting paragraph (d) from subclause
(4).
Ombudsman Act 1978
1. Section 5 is amended by omitting subsection (3).
Private Forests Act 1994
1. Schedule 2 is amended as follows:
(a) by omitting subclause (2) from clause 1
and substituting the following subclause:

(2) A person is not eligible to be
appointed as a director, other than
as the chief executive officer, if
the person has served 3
consecutive terms of office as a
director.
(b) by omitting from clause 7(h) "absence;
or" and substituting "absence.";

Solicitor-General Act 1983
1. Section 3(1) is amended by omitting "65" from
the definition of "age of retirement" and
substituting "72".
Supreme Court Act 1887
1. Section 6A(1) is amended by omitting "70" and
substituting "72".
Supreme Court Act 1959
1. Section 5(2) is amended by omitting "70" and
substituting "72".
Tourism Tasmania Act 1996
1. Clause 2 of Schedule 1 is amended by omitting
subclause (2).
Travel Agents Act 1987

(a) by omitting subclause (2) from clause 1;
(b) by omitting paragraph (b) from clause

Veterinary Surgeons Act 1987
1. Schedule 1 is amended as follows:
(a) by omitting clause 1;
(b) by omitting from clause 8(1)(j)
"subclause (2); or" and substituting
"subclause (2).";
(c) by omitting paragraph (k) from clause
8(1).
Workers Rehabilitation and Compensation Act 1988
1. Schedule 3 is amended as follows:
(a) by omitting clause 2;
(b) by omitting from clause 7(1)(f)
"resignation;" and substituting
"resignation; or";
(c) by omitting paragraph (g) from clause
7(1).
