STATE COASTAL POLICY VALIDATION
BILL 2003

A BILL FOR
An Act to validate the State Coastal Policy 1996 and
actions taken under or in pursuance of that Policy
Be it enacted by His Excellency the Governor of Tasmania,
by and with the advice and consent of the Legislative
Council and House of Assembly, in Parliament assembled,
as follows:
Short title
1. This Act may be cited as the State Coastal Policy
Validation Act 2003.
Commencement
2. This Act commences on the day on which this Act
receives the Royal Assent.
Interpretation
3. In this Act, "State Coastal Policy 1996" means the
policy of that name prepared and made under Part 2 of the
State Policies and Projects Act 1993 and notified in the
Gazette on 7 February 1996.

Validation of State Coastal Policy 1996
4. (1) The State Coastal Policy 1996 is and is to be taken
as always having been valid.
(2) Any act or thing done or omitted or required to
be done or omitted in pursuance of, in reliance on or
arising from the State Coastal Policy 1996 before the
commencement of this Act is taken to have been validly
done or omitted or required to have been done or omitted.
References in State Coastal Policy 1996 to coastal
zone
5. (1) A reference in the State Coastal Policy 1996 to the
coastal zone is to be taken as a reference to State waters
and to all land to a distance of one kilometre inland from
the high-water mark.
(2) For the purposes of subsection (1), "State
waters" has the same meaning as in the Living Marine
Resources Management Act 1995.
Administration of Act
6. Until provision is made in relation to this Act by order
under section 4 of the Administrative Arrangements Act
1990
(a) the administration of this Act is assigned to
the Premier; and
(b) the department responsible to the Premier in
relation to the administration of this Act is the
Department of Premier and Cabinet.
