PERSONAL INFORMATION PROTECTION
AMENDMENT BILL 2005

A BILL FOR
An Act to amend the Personal Information Protection Act
2004
Be it enacted by His Excellency the Governor of Tasmania, by
and with the advice and consent of the Legislative Council and
House of Assembly, in Parliament assembled, as follows:
1. Short title
This Act may be cited as the Personal
Information Protection Amendment Act 2005.
2. Commencement
(1) This Act commences on the day on which this
Act receives the Royal Assent.
(2) However, if this Act does not receive the Royal
Assent before the day on which the Principal Act
commences, this Act is taken to have
commenced, immediately after the Principal Act,
on that day.

Amendment
3. Principal Act
In this Act, the Personal Information Protection
Act 2004* is referred to as the Principal Act.
4. Section 9 amended (Law enforcement information)
Section 9 of the Principal Act is amended as
follows:
(a) by omitting "10(1)(a), (b), (c) and (e)"
and substituting "10(1)";
(b) by omitting "kept or made" and
substituting "collected or held".
5. Schedule 1 amended (Personal Information
Protection Principles)
Clause 10(6) of Schedule 1 to the Principal Act
is amended by inserting ", or without complying
with clause 1(5)," after "other person".
