PUBLIC HEALTH AMENDMENT (EXTENSION OF SMOKE
FREE AREAS) BILL 2004

A BILL FOR
An Act to amend the Public Health Act 1997 to expand the
definition of smoke-free areas to include all enclosed public
places and workplaces including bar and gaming areas, and
the inclusion of York Park, Bellerive Oval and fifty percent
of all outdoor dining areas operated by building occupiers.
Be it enacted by His Excellency the Governor of Tasmania, by and with the
advice and consent of the Legislative Council and House of Assembly, in
Parliament assembled, as follows:
Short title
1. This Act may be cited as the Public Health Amendment (Extension
of Smoke Free Areas) Act 2004.
Commencement
2. This Act commences on the day on which it receives the Royal
Assent.
Principal Act
3. In this Act the Public Health Act 1997 is referred to as the Principal
Act.
Act binds the Crown
4. This Act binds the Crown in right of Tasmania and, so far as the
legislative power of Parliament permits, in all its other capacities.
Section 67B Amended (Smoke-free areas)
5. Section 67B (1) of the Principal Act is amended as follows:
(a) By deleting subsection (g) and inserting the following new
subsection
(g) The public outdoor venues Bellerive Oval and York
Park;
(b) By inserting new subsection (h) after subsection (g) -
(h) 50% of all outdoor dining areas operated by building
occupiers.
Section 67B Amended (Smoke-free areas)
6. Section 67B (2) is amended by repealing subsections (d) and (e)
