MANAGEMENT AMENDMENT BILL 2008

A BILL FOR
An Act to amend the National Parks and Reserves
Management Act 2002
Be it enacted by His Excellency the Governor of Tasmania, by
and with the advice and consent of the Legislative Council and
House of Assembly, in Parliament assembled, as follows:
1. Short title
This Act may be cited as the National Parks and
Reserves Management Amendment Act 2008.
2. Commencement
This Act commences on the day on which this
Act receives the Royal Assent.
3. Principal Act
In this Act, the National Parks and Reserves
Management Act 2002* is referred to as the
Principal Act.

4. Section 30 amended (Functions and powers of
managing authority in relation to reserved land)
Section 30 of the Principal Act is amended as
follows:
(a) by inserting the following paragraph after
paragraph (c) in subsection (3):
(ca) to take any steps or undertake any
activities that the managing
authority considers necessary or
expedient for the purposes of
preventing, managing or
controlling fire in reserved land,
having regard to the management
objectives for that reserved land;
and
(b) by omitting from subsection (3)(d)
"paragraph (a), (b) or (c)" and
substituting "paragraph (a), (b), (c) or
(ca)";
(c) by inserting the following subsection
after subsection (3):
(3A) Subsection (3)(ca) does not apply
to fire in reserved land that
originates in, and is confined to, a
structure, as defined in the Fire
Service Act 1979, in that reserved
land.

5. Section 88A inserted
After section 88 of the Principal Act, the
following section is inserted in Part 6:
88A. Code of practice for managing fires in
reserved land
The Minister may approve a code of
practice for the purposes of providing
practical guidance to
(a) the managing authority in respect
of its functions in relation to
preventing, managing or
controlling fire in reserved land,
having regard to the management
objectives for that reserved land;
and
(b) any other person involved in the
undertaking of any such
functions.
