LAND TITLES AMENDMENT BILL 2005

A BILL FOR
An Act to amend the Land Titles Act 1980
Be it enacted by His Excellency the Governor of Tasmania, by
and with the advice and consent of the Legislative Council and
House of Assembly, in Parliament assembled, as follows:
1. Short title
This Act may be cited as the Land Titles
Amendment Act 2005.
2. Commencement
This Act commences on the day on which this
Act receives the Royal Assent.
3. Principal Act
In this Act, the Land Titles Act 1980* is referred
to as the Principal Act.

4. Section 169E amended (Prescribed fees)
Section 169E(1) of the Principal Act is amended
by omitting "The" and substituting "Subject to
section 169EA, the".
5. Section 169EA inserted
After section 169E of the Principal Act, the
following section is inserted in Part XIII:
169EA. Exemptions from fees
(1) A fee is not payable under this Act for
(a) a dealing for the purposes of, or
in accordance with
(i) an agreement, deed or
other instrument referred
to in section 90(1) of the
Family Law Act 1975 of
the Commonwealth; or
(ii) an order made under the
Relationships Act 2003 or
a prescribed agreement;
or
(b) a deed or other instrument
executed by a person for the
purposes of, or in accordance
with, an order or financial
agreement made under Part VIIIA
of the Family Law Act 1975 of
the Commonwealth.
(2) In this section

"prescribed agreement" means an
agreement that is
(a) a personal relationship agreement
or separation agreement within
the meaning of the Relationships
Act 2003; and
(b) in accordance with paragraphs
(b), (c), (d) and (e) of section
62(1) of that Act.
