GAMING CONTROL AMENDMENT BILL
2004

A BILL FOR
An Act to amend the Gaming Control Act 1993
Be it enacted by His Excellency the Governor of Tasmania,
by and with the advice and consent of the Legislative
Council and House of Assembly, in Parliament assembled,
as follows:
Short title
1. This Act may be cited as the Gaming Control
Amendment Act 2004.
Commencement
2. This Act commences on 1 July 2004.
Principal Act
3. In this Act, the Gaming Control Act 1993* is referred to
as the Principal Act.

Section 112M repealed
4. Section 112M of the Principal Act is repealed.
Section 124 amended (Membership of Commission)
5. Section 124 of the Principal Act is amended as follows:
(a) by omitting subsection (1) and substituting the
following subsections:
(1) The Commission consists of 3
persons, not more than one of whom is a State
Service officer or State Service employee.
(1A) The members of the Commission
are appointed by the Governor on the
recommendation of the Minister.
(b) by omitting subsection (4) and substituting the
following subsection:
(4) A member of the Commission who is
not a State Service officer or State Service
employee is appointed by the Governor as
chairperson of the Commission.
Section 127 amended (Power of Minister to give
directions to Commission)
6. Section 127 of the Principal Act is amended by
inserting after subsection (5) the following subsections:
(6) The Minister is to cause notice of each
direction given to the Commission under subsection
(1) and each revocation of any such direction to be
published in the Gazette.

(7) A notice under subsection (6) is not a
statutory rule within the meaning of the Rules
Publication Act 1953.
Section 140 amended (Accounting records)
7. Section 140 of the Principal Act is amended as follows:
(a) by omitting from subsection (3) "gaming
operator, licensed provider and prescribed
minor gaming operator" and substituting
"gaming operator and licensed provider";
(b) by omitting subsection (5).
Section 143A amended (Monthly returns by lucky
envelope suppliers)
8. Section 143A(2) of the Principal Act is amended by
omitting `endorsed with the words "Tas. Tax Paid"'.
Sections 150AC, 150AD and 150AE repealed
9. Sections 150AC, 150AD and 150AE of the Principal Act
are repealed.
