GAS AMENDMENT BILL 2005
(Brought in by the Minister for Infrastructure, Energy and

A BILL FOR
An Act to amend the Gas Act 2000 and the Gas Pipelines
Act 2000
Be it enacted by His Excellency the Governor of Tasmania, by
and with the advice and consent of the Legislative Council and
House of Assembly, in Parliament assembled, as follows:
PART 1 PRELIMINARY
1. Short title
This Act may be cited as the Gas Amendment
Act 2005.
2. Commencement
This Act commences on the day on which this
Act receives the Royal Assent.

PART 2 GAS ACT 2000 AMENDED
3. Principal Act
In this Part, the Gas Act 2000* is referred to as
the Principal Act.
4. Section 3 amended (Interpretation)
Section 3(1) of the Principal Act is amended as
follows:
(a) by omitting "customer;" from paragraph
(b) of the definition of "gas supply point"
and substituting "customer; or";
(b) by inserting the following after
paragraph (b) in the definition of "gas
supply point":
(c) if paragraphs (a) and (b) do not
apply, the point of supply
between a pipeline, or a pipeline
of a class of pipelines
(i) declared under section
3(3) of the Gas Pipelines
Act 2000 to be treated as a
transmission pipeline for
the purposes of that Act;
and
(ii) declared under
subsection (3) of this Act
to be treated as not

forming part of a
distribution system for the
purposes of this Act
and a gas installation;
(c) by inserting the following definition after
the definition of "licence":
"licensee under the Gas Pipelines
Act" means the holder of a
pipeline licence granted and in
force under Division 3 of Part 2
of the Gas Pipelines Act 2000;
5. Section 52 amended (Offence to supply or sell gas
for unsafe gas installation)
Section 52(2) of the Principal Act is amended by
inserting "or licensee under the Gas Pipelines
Act" after "entity".
6. Section 53 amended (Mandatory reporting of gas
incidents)
Section 53(2) of the Principal Act is amended by
inserting "or licensee under the Gas Pipelines
Act" after "entity".

7. Principal Act
In this Part, the Gas Pipelines Act 2000* is
referred to as the Principal Act.
8. Section 34 amended (Mandatory reporting of
incidents)
Section 34 of the Principal Act is amended by
omitting subsection (2).
