EDUCATION AND TRAINING (FURTHER
CONSEQUENTIAL AMENDMENTS) BILL 2008

A BILL FOR
An Act to amend certain Acts consequentially on the
enactment of the Education and Training (Tasmanian
Academy) Act 2008, the Education and Training
(Tasmanian Polytechnic) Act 2008, the Education and
Training (Tasmanian Skills Institute) Act 2008 and the
Education and Training (Repeals and Transitional
Provisions) Act 2008
Be it enacted by His Excellency the Governor of Tasmania, by
and with the advice and consent of the Legislative Council and
House of Assembly, in Parliament assembled, as follows:
1. Short title
This Act may be cited as the Education and
Training (Further Consequential Amendments)
Act 2008.
2. Commencement
This Act commences on 1 January 2009.
THIS BILL IS COGNATE WITH THE EDUCATION AND TRAINING (TASMANIAN
ACADEMY) BILL 2008, THE EDUCATION AND TRAINING (TASMANIAN POLYTECHNIC)
BILL 2008, THE EDUCATION AND TRAINING (TASMANIAN SKILLS INSTITUTE) BILL 2008,
THE EDUCATION AND TRAINING (REPEALS AND TRANSITIONAL PROVISIONS) BILL 2008
AND THE EDUCATION AND TRAINING (MISCELLANEOUS AND CONSEQUENTIAL
AMENDMENTS) BILL 2008

3. Consequential amendments
The legislation specified in Schedule 1 is
amended as specified in that Schedule.

SCHEDULE 1 CONSEQUENTIAL AMENDMENTS
Section 3
Children, Young Persons and Their Families Act 1997
1. Section 4(1)(d) is amended by omitting "school"
and substituting "a school, or other educational
or training institution,".
2. Section 32(10) is amended as follows:
(a) by omitting from paragraph (i) "school."
and substituting "school;";
(b) by inserting the following paragraphs
after paragraph (i):
(j) if there are concerns about the
child's education and the child
attends the Tasmanian Academy
established by the Education and
Training (Tasmanian Academy)
Act 2008, a person nominated by
the Tasmanian Academy;
(k) if there are concerns about the
child's education and the child
attends the Tasmanian
Polytechnic established by the
Education and Training
(Tasmanian Polytechnic) Act
2008, a person nominated by the
Tasmanian Polytechnic.

Judicial Review Act 2000
1. Clause 10(2) of Schedule 3 is amended by
omitting paragraph (a) and substituting the
following paragraph:
(a) the Tasmanian Skills Institute established
by the Education and Training
(Tasmanian Skills Institute) Act 2008;
Residential Tenancy Act 1997
1. Section 3(1) is amended by omitting "TAFE
Tasmania Act 1997;" from paragraph (d) of the
definition of "boarding premises" and
substituting "Education and Training
(Tasmanian Polytechnic) Act 2008 or the
Education and Training (Tasmanian Skills
Institute) Act 2008;".
State Service Act 2000
1. Part 2 of Schedule 1 is amended as follows:
(a) by omitting
TAFE Tasmania Chief executive officer
and substituting the following item:
Tasmanian Academy Chief executive officer

(b) by inserting after
Tasmanian Dairy Industry Chairperson of the Tasmanian
Authority Dairy Industry Authority
the following items:

Tasmanian Qualifications Authority Act 2003
1. Section 3(1) is amended as follows:
(a) by omitting paragraph (a) from the
definition of "course" and substituting
the following paragraph:
(a) a senior secondary course; or
(b) by omitting the definitions of "senior
secondary course" and "senior secondary
education" and substituting the following
definitions:
"senior secondary course" means a
course of study that is normally
undertaken, or intended to be
undertaken, during senior
secondary education;
"senior secondary education" means
secondary education that is

usually undertaken by persons
following the completion of the
fourth year of secondary
education, being the year
commonly known as Year 10;
Teachers Registration Act 2000
1. Section 3 is amended by omitting the definition
of "school" and substituting the following
definition:
"school" has the same meaning as in the
Education Act 1994;
2. Section 5(1)(b) is amended by omitting "and
colleges".
Youth Justice Act 1997
1. Section 65(1)(f) is amended by omitting "school
or employment" and substituting "employment
or school, or other educational or training
establishment,".
2. Section 90(6)(e) is amended by omitting "school
or employment" and substituting "employment
or school, or other educational or training
establishment,".
