EDUCATION AMENDMENT
(SMALLER CLASS SIZES) BILL 2003

A BILL FOR
An Act to amend the Education Act 1994 to provide for smaller class
sizes in State schools
Be it enacted by His Excellency the Governor of Tasmania, by and with
the advice and consent of the Legislative Council and House of
Assembly, in Parliament assembled, as follows:
Short title
1. This Act may be cited as the Education Amendment (Smaller Class
Sizes) Act 2003.
Commencement
2. This Act commences on 1 January 2006.
Principal Act
3. In this Act, the Education Act 1994* is referred to as the Principal
Act.

Section 25A inserted
4. After section 25 of the Principal Act, the following section is
inserted:
Class size limits
25A. (1) The Minister must ensure that the maximum size of a
State school class at the beginning of a school year does not exceed
the following limits
(a) 20 students in Preparatory and Year 1; and
(b) 25 students in Years 2, 3, 4, 5 and 6.
(2) The Minister is exempted from the application of
subsection (1) to a particular State school if an explanatory
statement, detailing reasons why subsection (1) could not be
complied with, is tabled in each House of Parliament of the State
within 60 days after the commencement of the school year.
