DAYLIGHT SAVING BILL 2007

A BILL FOR
An Act to promote the greater use of daylight in certain
months of the year and to provide for incidental matters
Be it enacted by His Excellency the Governor of Tasmania, by
and with the advice and consent of the Legislative Council and
House of Assembly, in Parliament assembled, as follows:
1. Short title
This Act may be cited as the Daylight Saving Act
2007.
2. Commencement
This Act commences on a day to be proclaimed.
3. Interpretation
In this Act, unless the contrary intention
appears
"regulations" means the regulations made
and in force under this Act;

"standard time" means the time declared by
the Standard Time Act 1895 to be the
standard time throughout this State;
"Tasmanian summer time" means the time
to be observed throughout this State as
fixed under this Act.
4. Advance of time
During the period prescribed in the regulations
for the purposes of this section, Tasmanian
summer time throughout the State is to be one
hour in advance of standard time and is to be
observed accordingly.
5. Construction of expressions of time in Acts, &c.
(1) Notwithstanding anything in any legal
instrument, where any time or period of time is
prescribed, specified or stipulated as the time at
which, or the period of time for which or during
which, or any part of which, the doing of any
act, matter or thing is required, permitted or
prohibited, that time, period of time or part of a
period of time, as the case may be, is, with
respect to any period during which Tasmanian
summer time is fixed under this Act to be in
advance of standard time, to be held to be, and is
to be determined by reference to, Tasmanian
summer time unless the contrary is expressed,
provided or stipulated in that legal instrument.

"legal instrument" means
(a) an Act (including this Act); or
(b) a regulation, rule, by-law,
proclamation, order, notice,
notification or other instrument
made under an Act (including this
Act); or
(c) any contract or agreement
(whether oral or in writing or
both); or
(d) any deed or other instrument
having legal effect.
6. Regulations
The Governor may make regulations for the
purposes of this Act.
7. Savings
(1) Except as otherwise expressly provided in this
Act, the provisions of the Standard Time Act
1895 are not affected by this Act.
(2) Nothing in this Act affects the use of standard
time for the purposes of astronomy, meteorology
or navigation, or the construction of any
document mentioning or referring to a point of
time in connection with any of those purposes.

8. Administration of Act
Until provision is made in relation to this Act by
order under section 4 of the Administrative
Arrangements Act 1990
(a) the administration of this Act is assigned
to the Premier; and
(b) the department responsible to the
Premier in relation to the administration
of this Act is the Department of Premier
and Cabinet.
9. Legislation repealed
The legislation specified in Schedule 1 is
repealed.
10. Legislation revoked
The legislation specified in Schedule 2 is
revoked.
