AUTHORITY AMENDMENT BILL 2003

A BILL FOR
An Act to amend the Ben Lomond Skifield
Management Authority Act 1995
Be it enacted by His Excellency the Governor of Tasmania,
by and with the advice and consent of the Legislative
Council and House of Assembly, in Parliament assembled,
as follows:
Short title
1. This Act may be cited as the Ben Lomond Skifield
Management Authority Amendment Act 2003.
Commencement
2. This Act is taken to have commenced on
31 December 2002.
Principal Act
3. In this Act, the Ben Lomond Skifield Management
Authority Act 1995* is referred to as the Principal Act.

Authority Amendment
Section 3 amended (Interpretation)
4. Section 3 of the Principal Act is amended as follows:
(a) by omitting the definition of "authorized
officer" and substituting the following
definition:
"authorized officer" means a police
officer, a ranger within the
meaning of the National Parks
and Reserves Management Act
2002 or a person appointed as an
authorized officer under
section 11;
(b) by omitting "section" from paragraph (b) of the
definition of "Management Plan" and
substituting "section, or under the National
Parks and Reserves Management Act 2002,".
Section 23 amended (Co-ordination of
administration with National Parks and Reserves
Management Act 2002 and Nature Conservation Act
2002)
5. Section 23 of the Principal Act is amended as follows:
(a) by omitting from subsection (1)(a) "Part III of
the National Parks and Wildlife Act 1970" and
substituting "Part 3 of the Nature
Conservation Act 2002";
(b) by omitting from subsection (1)(b) "that Act"
and substituting "the National Parks and
Reserves Management Act 2002";

(c) by omitting from subsection (2)(b) "National
Parks and Wildlife Act 1970" and substituting
"Nature Conservation Act 2002";
(d) by omitting from subsection (3) "Part III of the
National Parks and Wildlife Act 1970" and
substituting "Part 3 of the Nature
Conservation Act 2002";
(e) by omitting from subsection (4) "Section 26A of
the National Parks and Wildlife Act 1970" and
substituting "Section 56 of the National Parks
and Reserves Management Act 2002".
Section 23A amended (Business licences, leases and
licences under National Parks and Reserves
Management Act 2002)
6. Section 23A(1) of the Principal Act is amended by
omitting "section 25F, 25H, 25I, 25J, 26AAA, 26AA or
26AB" and substituting "section 42, 44, 45, 46, 49, 50 or
51".
Substitutions
7. Each of the provisions of the Principal Act specified in
Column 1 of Schedule 1 is amended by omitting "National
Parks and Wildlife Act 1970" on the number of occurrences
specified in Column 2 of that Schedule and substituting
"National Parks and Reserves Management Act 2002".
