WORKERS REHABILITATION AND COMPENSATION ACT 1986 - SECT 80A
(1) A Judge (other
than the Senior Judge) of the Industrial Relations Court of South Australia is
a Deputy President of the Tribunal.
(2) The Governor may,
on the nomination of the Minister, appoint a suitable person as a Deputy
President of the Tribunal.
(3) A person is not
eligible for appointment as a Deputy President of the Tribunal unless the
person is a legal practitioner of at least seven years standing.
(4) A person may be
appointed as a Deputy President of the Tribunal on a permanent or acting
basis.
(5) A person appointed
as a Deputy President of the Tribunal under this section ceases to hold that
office if the person—
(a)
dies; or
(b)
reaches the age of 65 years; or
(c) in
the case of a Deputy President appointed on an acting basis—completes
the term appointment and is not reappointed; or
(d)
resigns by written notice given to the Minister; or
(e) is
removed from office by the Governor for—
(i)
misconduct; or
(ii)
neglect of duty; or
(iii)
incompetence; or
(iv)
incapacity to carry out official duties satisfactorily.
(6) A Deputy President
appointed under this section is entitled to remuneration allowances and
expenses on a basis approved by the Governor.
(7) This section does
not derogate from the operation of the Judicial
Administration (Auxiliary Appointments and Powers) Act 1988
.
