WORKERS REHABILITATION AND COMPENSATION ACT 1986 - SECT 72P

72P—Transfer of business

        (1)         In a case involving any transfer of business, the Corporation may, as it thinks fit, apply any claims experience or other factor applying with respect to the business before the transfer to the employer who takes over the business on account of the transfer.

        (2)         For the purposes of subsection (1)

, a reference to a business includes a reference to any form of undertaking.

        (3)         Without limiting subsections (1)

and (2)

, a transfer of business between 2 employers will be taken to occur if there is a connection between the 2 employers under section 311 of the Fair Work Act 2009 of the Commonwealth.
