South Australian Health Commission (Yorke Peninsula
Health Service Incorporated) Proclamation 2005
under section 27 of the South Australian Health Commission Act 1976
1 The following hospitals are incorporated under the South Australian
Health Commission Act 1976:
(a) Central Yorke Peninsula Hospital Incorporated (see Gazette
23.5.1985 p1690; Gazette 22.2.1996 p1186);
(b) Southern Yorke Peninsula Health Service Incorporated (see Gazette
27.8.1992 p930).
2 It is now intended to establish an incorporated hospital under the
South Australian Health Commission Act 1976 to take over from the
hospitals referred to in clause 1 the function of providing health services
provided by those hospitals prior to the commencement of this
proclamation.
3 The governing bodies of the hospitals referred to in clause 1 have
consented to the establishment of the incorporated hospital and have agreed with
the Minister for Health on the terms of the constitution under which the
incorporated hospital is to operate.
This proclamation may be cited as the South Australian Health Commission
(Yorke Peninsula Health Service Incorporated)
Proclamation 2005.
This proclamation comes into operation on the day on which it is
made.
3—Establishment
of incorporated hospital
(1) An incorporated hospital is established to take over from the
hospitals referred to in clause 1 of the preamble the function of providing
health services provided by those hospitals prior to the commencement of this
proclamation and to provide health services in accordance with the constitution
referred to in clause 3 of the preamble.
(2) The incorporated hospital is assigned the name Yorke Peninsula
Health Service Incorporated.
4—Dissolution
of existing bodies
(1) The incorporation of each of the hospitals referred to in
clause 1 of the preamble is dissolved.
(2) It is declared that the transfer and vesting of any rights or
liabilities of a body whose incorporation is dissolved by this proclamation that
relate to the employment of any person will take effect with continuity of
employment and without termination of any employee's service.
