TRAINING AND SKILLS DEVELOPMENT ACT 2008 (NO 30 OF 2008) - SECT 42
42—Appeal to District Court
(1) An appeal to the
District Court may be made against a decision of the Commission—
(a)
refusing an application for the grant or renewal of registration or
accreditation; or
(b)
imposing or varying conditions of registration or accreditation; or
(c)
suspending or cancelling registration or accreditation; or
(d)
cancelling a qualification or statement of attainment.
(2) Subject to
subsection (4), an appeal must be instituted by a person within 28 days
of the making of the decision appealed against.
(3) The Commission
must, if so required by a person affected by a decision made by it, state in
writing the reasons for the decision.
(4) If the reasons of
the Commission are not given in writing at the time of making a decision and
the person affected by the decision (within 28 days of the making of the
decision) requires the Commission to state the reasons in writing, the time
for instituting an appeal runs from the time at which the person receives the
written statement of those reasons.
