South Australian Consolidated Regulations19—Sale of water allocations by Minister
(1) The Minister may
sell water allocations by public auction or tender or, if either of those
methods fail, by private contract.
(2) The following
provisions apply in relation to the sale by the Minister of a water allocation
by public auction:
(a) the
Minister must, by notice published in a newspaper circulating generally
throughout the State, give at least 14 days notice of the time and place at
which the auction will be held; and
(b) the
Minister may refuse to sell an allocation if bidding for the allocation does
not reach the reserve price fixed by the Minister.
(3) The sale of a
water allocation, whether by public auction or tender or by private contract,
is subject to the Minister being prepared to endorse the allocation in
accordance with the Act on a water licence held by the purchaser.
