South Australian Consolidated Regulations19—Expiation of certain offences
(1) Pursuant to
section 122A of the Act, the following amounts are fixed as expiation fees in
respect of offences against the following sections:
|
Section |
Expiation fee |
|---|---|
|
Section 59—Failing to register as an employer within the time allowed
under that section |
(a) $360
indexed; or (b) 5%
of the aggregate remuneration paid to the employer's workers during the period
for which the employer is in breach of the section, whichever is the greater. |
(2) For the purposes
of this regulation, a fee under subregulation (1) that is expressed to be
indexed will be adjusted on an annual basis (according to calendar years)
beginning on 1 January 2000 so that the fee payable in respect of an
offence committed on or after that date will be an amount (calculated to the
nearest multiple of $10) that bears to the relevant fee prescribed by
subregulation (1) the same proportion as the Consumer Price Index for the
September quarter of the year immediately preceding the year of the offence
bears to the Consumer Price Index for the September quarter, 1998.
(3) In this
regulation—
"remuneration" has the same meaning as under Division 4 of Part 5 of the Act
(but does not include remuneration paid to any worker in respect of whom an
employer is not required to be registered under section 59 of the Act).
