OCCUPATIONAL HEALTH, SAFETY AND WELFARE REGULATIONS 1995 - REG 1.2.7

1.2.7—Designers of buildings

        (1)         Subject to any express provision in a particular regulation to the contrary, a person who designs a building, other than domestic premises, that is reasonably expected to comprise or include a workplace must, insofar as may be relevant to health, safety or welfare in, on or about the building, ensure compliance with any regulation that, pursuant to regulation 1.2.14 and Schedule 2, applies to the designers of buildings.

        (2)         In the event of a contravention of, or failure to comply with—

            (a)         subregulation (1); or

            (b)         any other regulation that specifically applies to persons who design buildings,

the person is guilty of an offence.

Penalty:

            (a)         if the relevant regulation prescribes a penalty—that penalty;

            (b)         in any other case—a Division 6 fine.
