RESIDENTIAL TENANCIES ACT 1995 - SECT 57
57—Landlord's duty to keep proper records of rent and other payments
(1) A landlord under a
residential tenancy agreement must ensure that the following information is
recorded in respect of payments received under the agreement:
(a) the
date on which the payment was received;
(b) the
name of the person making the payment;
(c) the
amount paid;
(d) the
address of the premises to which the payment relates;
(e) if
the payment is for rent—the period of the tenancy to which the payment
relates;
(f) if
the payment is a bond—a statement of that fact;
(g) if
the payment is not for rent or a bond—a description of the purpose of
the payment, including, if applicable, the period of time to which the payment
relates.
Maximum penalty: $20 000.
Expiation fee: $1 200.
(2) A person must
not—
(a) make
a false entry in a record of a payment received under a
residential tenancy agreement; or
(b)
falsify the record in any other way.
Maximum penalty: $25 000.
