19—Cost of traffic control devices and duty to maintain
(1) Subject to this
section, the cost of installing, maintaining, altering, operating or removing
a traffic control device must be borne by the road authority in which the
care, control or management of the road to which the device relates is vested.
(2)
Subsection (1) applies subject to any provision of another Act or a
regulation under this Act that declares that the cost of installing,
maintaining, altering, operating or removing traffic control devices of a
specified class must be borne by a specified authority, body or person (other
than the road authority referred to in that subsection).
(5) The cost of
installing, maintaining, altering, operating or removing a
traffic control device—
(a) the
purpose of which is to regulate, restrict or prohibit the parking of vehicles;
and
(b)
which has been, or is to be, installed by a council or other road authority
under powers conferred by statute,
must (except where the traffic control device is a device of a class declared
by regulation to be a class of traffic control device to which the provisions
of subsection (1) apply despite this subsection) be borne by that council
or other road authority.
(6) An authority, body
or person that is liable to bear the costs in relation to a
traffic control device, must maintain the traffic control device in good
order.
