ROADS (OPENING AND CLOSING) ACT 1991 - SECT 38
38—Width of roads
(1) Subject to this
section, no road opened pursuant to this Act may be less than 12 metres wide
in any place and no road may be closed in part so that it is less than 12
metres wide in any place.
(2) The
Surveyor-General may, by instrument in writing—
(a)
declare that the minimum width fixed by this section does not apply to any
specified road; and
(b) fix
a minimum width for that road that is less than the minimum width otherwise
required by this section.
(3) Any road opened
pursuant to this Act may be continued at a width of less than 12 metres if the
continuation is at least of the same width as the road so continued.
(4) For the purpose of
this section, the width of a road is the shortest distance from one boundary
of the road to the opposite boundary.
