PUBLIC TRUSTEE ACT 1995 - SECT 4
(1) There is to be a
Public Trustee .
(2) The Public Trustee
is to be an employee in the Public Service of the State appointed to the
office of Public Trustee by the Governor.
(3) The office of
Public Trustee may be held in conjunction with a position in the Public
Service.
(4) The Public
Trustee—
(a) is a
body corporate; and
(b) has
perpetual succession and a common seal; and
(c) is
capable of suing and being sued; and
(d) is
an instrumentality of the Crown and holds property on behalf of the Crown; and
(e) has
the functions and powers assigned or conferred by or under this or any other
Act.
(5) The Minister may
assign an employee in the Public Service to act as the Public Trustee—
(a)
during a vacancy in the office of Public Trustee; or
(b) when
the Public Trustee is absent from, or unable to discharge, official duties.
