South Australian Consolidated Acts6D—Duty of corporate agency members to exercise care and diligence
(1) A
corporate agency member must at all times exercise a reasonable degree of care
and diligence in the performance of his or her functions.
(2) If a
corporate agency member is culpably negligent in the performance of his or her
functions, the member is guilty of an offence.
Penalty: Division 4 fine.
(3) A
corporate agency member is not culpably negligent for the purposes of
subsection (2) unless the court is satisfied the member's conduct fell
sufficiently short of the standards required under this Act of the member to
warrant the imposition of a criminal sanction.
(4) A
corporate agency member does not commit any breach of duty under this section
by acting in accordance with a direction or requirement of the
relevant Minister.
