PETROLEUM (SUBMERGED LANDS) ACT 1982 - SECT 99
(1) A permittee,
lessee or licensee shall not make a well any part of which is less than 300
metres from a boundary of the permit area, lease area or licence area, as the
case may be, except with the consent in writing of the Minister and in
accordance with such conditions, if any, as are specified in the instrument of
consent.
(2) Where a permittee,
lessee or licensee does not comply with subsection (1), the Minister may,
by instrument in writing served on the permittee, lessee or licensee, as the
case may be, direct him to do one or more of the following, within the period
specified in the instrument:
(a) to
plug the well; and
(b) to
close off the well; and
(c) to
comply with such directions relating to the making or maintenance of the well
as are specified in the instrument.
(3) A person to whom a
direction is given under subsection (2) shall comply with the direction.
Maximum penalty: $10 000.
